Yeah, that's the fair use bit. Unfortunately, when it comes down to actually defining where Fair Use ends and Copyright infringement begins, things get a bit more muddled.

Andy Warhol wasn't selling soup, but Campbell's tried suing him over his painting of their product's can (albeit they later dropped it since it turned out to be good publicity).
