The CFC classified launchers (whether you call them "flare" or "grenade", 37mm or 40mm makes no difference) as restricted firearms, requiring registration last year. If it's legally called a firearm now, then it's replica is a prohibited device.

There's a few threads on it over on CGN, and I made one here last year on that issue.
