yeah, the hood does look quite a bit the same design as the old OD parka.

Hopefully it'll be removed in a day or so once CFNIS gets wind of it, and the seller will find himself in the special part of prison reserved for child molesters and people who talk in movie theaters..

Someone put up a JTF-2 CADPAT tac vest last week... by next morning it didn't exist.

No, but it's against ebay policy to sell stolen property. The item may be removed, unless he can prove that it was aquired through legitmate means....meaning the military knows he has it and are okay with that.
