hallo
i have sold some stuff to a user from here... he must give mi 190$ for it... he got the stuff 13. of july, but he didnt pay yet...
i also wrote him a pm, but he didnt reply... i see him sometimes in msn messenger, mostly he is "away"... if he is online, he doesnt reply...

what can i do?

Exactly... I think we have an excelent system of trade here, but if you get fucked, and dont use the system to its fullest, ie negative feedback, alert mods of his "games", ect your just as stupid as the one that took you.

It would be nice to help people out. but there is never a win:win:win trust me the more people involved the more people that get dragged in the mud.

We had a few guys here in Ottawa that where causing problems, the first one was a big one and I got dragged into it and was asked to ban the player from my field and I did. boy did that go over well!, the second bad deal I did not want anything to do with it. When lisa asked me for info I gave it to her and said that is as far as I am going.

Next thing I know, People are bashing me for not getting involved. So you a fucked if you do not help, and fucked if you do!

SO if you are going to help someone you better have your ass covered by both sides.

There's only one way to deal with a con artist or a 'cheater'. You can either A) Get rid of them or B) Do nothing and watch it happen to more people.

There's a bunch of ways to get rid of them, too. But, unfortunatly, some people will do nothing because they think it wont work.

It's up to the person who got screwed to report it to 'authorities' and then deal with it in whichever way he wants to deal with it. Banning? He requests it. Negative Feedback? Up to them. Nothing else can be done if they decide not to do anything.

What address did you mail the parts to? I hope you did not mail it to a PO Box. Did you have to package tracked to ensure it was received by the person in question? Funny how he ignores you continually though. If you provide more details on this person we may be able to track down his whereabouts.

A fella in the Ukraine tried to screw myself, Vlad and another user (that never paid me back for his shipping costs ... I'll get my money from you believe me) but we got in touch with people in his area (who put a little pressure on the guy to do the right thing), and low and behold after 10 months of waiting we finally received our items. Without the help of locals there is little you can do. Thankfully most of us will offer help when this sort of shit seems to happen. You have to be careful, there are a lot of scumbags in this world.

It's not hopeless, your chances are just slim.

Whoever he is, he's been age-verified. To show up here AND get age-verified just to rip off one person? That doesn't make sense to me. Whoever verified this guy might remember him, and now with all this drama, do you think he'll be welcome anywhere? He's alienated himself from the scene.

First, try contacting your shipping carrier to see if they have any details on a seizure. Then call the Canadian Border Services Agency to see if they have any other details.

1-905-625-7100

1 is country code for canada
905 is area code
The rest is the phone number. I don't know if you need to dial any extra numbers to hit Canada from overseas.

Call that number in 2 to 3 hours from the time my message is posted and speak to someone there to try and trace the package. This agency is responsible for the seizure if it truly took place.

That number is actually for the east coast of Canada, but should be able to get transferred to the west coast CBSA.

Contact your shipping carrier and let us know how far you got.
It may also help if you post any other pertinent information, such as who the shipping carrier you used was, any package tracking numbers, etc etc.

If you provide us with the tracking information, and you shipped via your country's federal/national postal service, then it will get transferred to Canada Post when it arrives on Canadian soil. That tracking information is easily available to us all. I'm (unfortunately) VERY familiar with what a seized package looks like based on the tracking information. I have several of the Canada customs phone numbers in my directory (at least enough of the numbers to get me around.)

By providing this information to us, we can assist you further and quicker.

If I can see what the package information looks like, I may be able to help you determine the truth behind Dirty Sanchez's story.


Sorry, I'm really tired at the moment, so just to make sure all the babbling I'm saying is clear,

Provide us with this information:
1) Who your shipping carrier was (ie UPS? Fedex? DHL?)
2) What the tracking number for the package was
3) What date did you ship the package?


This is a situation of common sense (or lack thereof) and you didn't protect yourself.

It's like... how many grocery stores do you know of that will let you take all the products home, cook it, eat it, and then come back later to pay?

I know. Tough love. But I hope this is a lesson well learned.

By the looks of the tracking info, there were no delays inside of Canada that would suggest a siezure by our customs.

Actually...

Read it over again, very carefully.

It was sitting in customs for exactly one month. It entered customs on JUNE 7th. It was released to Canada Post from customs on JULY 7th.

That's the sign of a seizure.

But regardless - just because they seized the items, it's not your problem as the exporter. In the eyes of Canadian customs, the importer of the goods is always the one responsible for the nature of the goods entering the country.

He still owes you money.

Spitfire, I'll give customs a call for you and look in to it. It looks like the agency it entered was actually the number that I gave you and that number is local to me.

I'll get the details of the seizure from them.




As for Dirty Sanchez, his age verification has been revoked and his account is now under review and investigation, pending payment to you. It is his responsibility to go through the legal process of appealling the decision of customs and ensure that he has his proper paperwork in order when importing goods. He has 90 days from the day the item entered the country.

This is turning in to another case of "buy it in Canada or risk seizure." In the end, Canada customs is the ultimate controller of what gets in to the country or not and if they deem an item to be not in the best interests of a Canadian citizen to possess.... then they seize it, regardless of what is already written in government legislation or not.

Ya, in quebec they are backwards with their dates, days are in the month spot and month in the day spot, therefore I didn't look at the last spot on the dates.

Illusion is right, 1 month in customs = possible siezure. However the case, as stated Dirt Sanchez is now responsible for fighting the siezure, and still owes you money, Spitfire.

I just got a call back from Canada Customs. Here's what we've learned:

The package came in to Canada Customs on June 7th. The inventory number attached to this package is CU327090215CA.

Due to the nature of the parts in the package (gun parts), they were sent to the Canada Prohibited Importations Unit for further inspection of the parts.

July 6th, ALL of the parts were cleared by the Canadian Prohibited Importations Unit and sent back to Canada Customs. - NO PARTS WERE SEIZED.
Canada customs tagged the package with a Canadian value of $171.21 and applied applicable taxes, duties, brokerage fees, etc totalling $27.25.

July 7th, the package was sent back to Canada Post.

From there, the package was delivered to the importer.

Again, NO PARTS WERE SEIZED. The delay in the shipment was due to a long inspection process of the parts.

Had any of the parts actually been seized, then Dirty Sanchez would have received a letter in the mail from Canada Customs. If he still believes the parts were seized... well too bad. That's not your problem, Spitfire. You held up your end of the bargain, which was to safely export the product out of your country - which you did. His end of the bargain is to import it AND pay you.

If he TRULY did not receive those items, then they must have fallen out of the package or gotten lost along the way and in that case, he should contact Canada Post to claim a refund on those parts. But the fact still remains, that's not your problem. HE STILL OWES YOU MONEY.

I hope this information helps you, Spitfire. Apply some pressure on Dirty Sanchez. If he is still not forthcoming with the funds, further "action" can be taken to ensure that he holds up his end of the deal.

Wow thats brutal... I think you should contact the 4 main local clubs and see about having him banned from playing until this can be resolved. Its posted in his words he recieved the package, customs didnt seize anything, seems to me hes an asshat looking to make a deal on some one who cant "do" anything about it.

And plus... it was most likely customs that wrote "firearm parts" on the package as that was the exact term that customs gave to me. As an importer, he HAS to know that customs reserves the right to re-classify goods if they deem it necessary for duties and such.

And plus, yes, he CAN tell canada post that he was carrying firearms parts. The only thing that's prohibited for them to transport are goods that customs claims are prohibited... which general parts ARE NOT prohibited.

Holy fuck, I don't check these boards for a couple months and I have a 6 page thread dedicated to me? First of all, I have NOT been ignoring spitfire on msn messenger or whatever he claims. The only time I get to talk to him is between 2:30am-3:30am since he lives in Switzerland? The reason why he isn't getting his full amount of $190cdn is because all items were NOT recieved. I say customs has it, and he says wrong. Now he thinks canada post has lost it. Whether or not any of you believe me is up to you. Its not like i'm shafting the guy, if i was I wouldn't even still be chatting with him. Spitfire, I am gonna pay you, just not the full amount since I didn't recieve all the items!

When I spoke to Canada Customs, they said that there was a trigger set and trigger guard in the package, and hence, why the package was sent to the prohibited importations unit. The CPIU eventually CLEARED those items and sent them back to the Canadian Border Services Agency who forwarded them BACK to Canada Post for transport to you.

In other words, NOTHING WAS SEIZED. Had Canada Customs actually seized any goods, you would have received a letter about 3 weeks ago. DID YOU RECEIVE A NOTICE OF SEIZURE? If you did, please scan it and post it online for us to see. If you did not receive a letter, then nothing was seized. Just because the item is not in the package (that's covered with customs tape) does not mean that anything was seized.

If you still have questions, call the CBSA directly for clarification. The number is posted on page 4 of this thread, as well as the inventory tracking number that I acquired for you. SPEAK TO THEM and they will describe all the parts in the package to you as they did to me.

CBSA claims they released all items back to Canada Post. If that is the case, then Canada Post is responsible for refunding the cost of all missing goods to you.

NOBODY here is saying you're an outright liar. You're just misinformed on the situation and shafting Spitfire by not fulfilling your end of the bargain.

I have been importing goods at least once a month and have dealt directly with Canada customs on many occassions for years. Specifically, I have been importing airsoft goods since 2002 on an almost monthly basis. I am familiar with how the system works, especially in regards to airsoft. If your goods are truly seized, the decision can always be appealed.

With all that said, the point and fact STILL remains: Spitfire fulfilled his end of the bargain. It is YOUR DUTY to fulfill YOUR end of the bargain by paying him for what he sent to you. What illusion has said makes a lot of sense, and has kinda made me realize it is MY fault for not really spending the time to see wtf happened to my parts. But you also have to see it from my point of view, I mean You wouldn't wanna pay full price for something to didn't recieve would you? I did recieve some of the parts, but not all the things that were agreed upon for $190. I will see if spitfire is on-line tonight and we will work something out.

It would be much more better idea to give an idea what you DID receive, and what you did not.

From the call Illusion got from CDN Customs, Trigger Guard and Trigger Set was in the package, and the spring strengthener should be in it since you said you got a bunch of "rings" in the msn conversation. But the trigger guard and set itself makes up the bulk of the $190. You offer to pay $60?!

It's obvious nothing was seized in this case, so if any items is missing to you (Dirty Sanchez), it's the fault of Canada Post. You should be following up with CP if items are missing, and not going "oh well, I'll negotiate a better price because some items went missing during shipping instead of claiming insurance on the shipment.

I'm not judging you yet on this, but your unwillingness to discuss seems a little iffy. Why can't YOU take the initiative to email him instead of asking Spitfire to email you. If it's a CP issue, work closely with Spitfire to track the items back or your money back since Spitfire fully insured the items.

Well I can't prove that he didn't send all the items as was discussed, I'm just bitter about the whole thing. Its basically his word against mine vise versa. Its just too bad he couldn't send the package C.O.D. as i requested that way none of this bullshit would have escalated to this point. I have contacted the post office and my request is under review, so hopefully i will get some money back for my lost goods. I would have liked to be mature about this whole thing, but its kinda hard when you have internet gangsters calling me a douche and semen recepticle... ok, maybe not that last one. It's not Spitfire's fault they don't offer such service in Swiss. It would of been way better on Spitfire's end if it was COD and much more "bullshit" on your end, first of all, you would of paid $190 at your door, he would of gotten the money and then you realize there are things "missing".

But then when that happens, u come back to the whole fiasco about him not senidng the right parts, and the go check through the same process Spitfire (where Illusion helped greatly) did, blah blah blah blah.

Anyway, my point is, COD wouldn't of helped in this situation, you would of still have to go call up customs to see if they seized parts, then claim insurance at Canada Post.

The gall some people display here is truely amazing sometimes. RE: Customs may have potentially removed an item or two from the shipment so fucking over the seller is completely fine ... ? What kind of logic is this? If Dirty had not been tracked down Spitfire would never have seen a dime. I'm still very skeptical that any items were actually missing - if there where items missing I'd get in touch with the seller, not fucking ignore him for a month. It sounds like one of those "my little brother posted that" type of scenarios and I don't believe a word of it.

Just my opinion, and I could be wrong but it's how I feel. I really don't have patience for this type of behaviour at all. There is still no excuse.

At any rate Spitfire, next time ... CASH UP FRONT. This time you got lucky. Don't mess around with that C.O.D. crap either. When a buyer flakes or can't pay for the items on delivery (yes it happens) then the items get returned to you and you get burned for the shipping price (twice - there and back to you) so avoid that aswell.
