TRADE ISSUE - BCAC J-AIR
I will post this soon on the BCAC boards for reference, but it is likely all my replies will be limited to ASC.
As well as leaving negative feedback for J-Air of BCAC(Pvt.Joker on ASC). I want to bring this to the public's attention, as I'm seeking help in the form of an intermediary to solve this problem. Earlier in the month, J-AIR and myself worked out a trade deal in regards to my OD TM14, and his CA/TM M4RIS with M203. Those curious about the specifics of his M4 that won't be sighted in this post, may find the for sale thread here:http://www.airsoftcanada.com/showthread.php?t=19003. We agreed to trade my TM M14, which was in near mint condition, plus 6 additional TM M14 mags (lo-caps_ for what is listed in the above linked ad. Once we started to work out the specifics of the deal, other issues became apparent. I was told that the seller has disabled Semi-Auto which I'm fine with, but this set off some warning bells, that i should have listend to, about the rest of the gun. I was told the G&P PEQ that is pictured in the ad was in fact broken, and he had an ICS Peq unit in near perfect condition, I elected to take the non-broken ICS one. I was also told that the internals, and AEG were in excellent condition, other than a few dings and scratches. Upon arrival of the M4 ( which was stuffed in a box too small for it.) I found a few very disheartening things: - The clamp on the PEQ was cracked down the middle, likely from overtightening on the rail. As such its not possible to attach it to the RIS (when i tried to screw it on, the bottom of the clamp actually fell off). Making it not-possible to use the AEG, since its an external battery. - the RIS and M203 were not properly mounted to the AEG. at the time, a silver washer was wedged between the body and the RIS holding it in place loosely, and the RIS unit, as well as the M203 is able to rotate around the outer barrel making it unsafe for use (if i took a fall with this thing, i see myself seriously fucking the front M203 mount, and or destroying anything on the RIS The RIS also will come off if you pull with any real force. - After initially receiving this and talking to J-air, he agreed to send his other "broken" PEQ that was initially pictured to see if i could jury-rig a solution. I then returned to my apartment in scarborough (it should be noted that all my gear resides at my parents house, since i cannot have them here at my apartment.) I assumed that he would come foreword with any other problems, I was wrong. - Last weekend I returned home and cracked open the body ,only to find the AEG lacks a nozzle. It is very clear that the brass tube from the cylinder head was protruding from the mechbox ,without the black plastic nozzle that should be there allowing to fire. I have not yet been able to drop the M4 off with a gun-tech to get a more detailed report, but I fear further problems within the AEG itself. Once I confronted J-Air with this, he began to use profane words and refused any compensation. He then stated that the M14 arrived in FUBARED condition, yet he didn't provide pictures, nor contact me when the M14 arrived nor did he request I begin the process to make an insurance claim on the parcel through CP. Needless to say I'm VERY disappointed in this transaction, and this will likely end any dealings I may have with the membership of BCAC. I would appreciate any assistance in getting J-Air to step foreword and do the right thing, help get this M4 running in the condition that it was stated to be in, and to not stick with his concluding PM line: "If you think I am going to compensate you in any way-give you're head a shake" Thanks, Mike |
I Think that this IS TOTALY unacceptable. Please provide his house address. If he won't agree you can go pry your M14 out of his little hands and keep the 2 M4s or beat him with them untilll he is knocked out and THEN give back one.

Goldman, you've already posted in the BCAC forums and I'm sure the admins will work with you to resolve this dispute. There's no point in airing the dirty laundry on ASC because nobody else here can help and the dispute has not yet been sorted out.

I posted it here, becuase previous posts i'd made on BCAC had been locked, or trashed, i'm holding a public record of this until it has been resolved.
I'll also note, nothing happend about this until it was also posted on ASC. my precvious posts were lcoked or trashed, as I already stated. I want EVERYONE to be aware of this deal as I have absolutely nothing to hide or for that much, use my position at another board to hide behind. |

I can understand posting here for the public interest but this is still an ongoing dispute and I don't think it's in the public interest to air this drama as it plays out. This is the reason the posts on BCAC have been moved to the admin section where it can be hashed out.

I will see whats going on the BC end..to a point, I am not going to mediate anything as I have no time to do it. I will say this though. that gun never had any problems when I was shot by it....and Jair is a competent gunsmith, I cannot see him trying to fuck you over.

As with anything, there are two sides to every story -and the side I heard paints things in a very different light. I see you fail to mention any wrongdoing by yourself...
For one thing, you two agreed to a trade and to ship simultaneously, but when you received the m4 a week later, you hadn't even shipped the m14 yet (or, what was it, got your parents to ship it for you?), and after holding onto it for a while longer you in fact you had lied about shipping it before you actually shipped it. Apparently the peq issue you were well aware of, so you shouldn't be acting like it's some big surprise. Again, apparently the same thing with the 203. This is why he was trading a thousand dollar gun for a used m14. Still, you started complaining to him about it, while still not shipping your gun to complete the trade, de facto holding it hostage. When I spoke to him he still hadn't received your m14, so I guess you finally shipped it at some point (and what, you shipped a broken gun?). If you are trading a gun and both of you are shipping on the same day, you make sure that you do. Don't blame your parents. What 'local response' do you want? Both of you are saying the other one fucked them over. One person I know, and has served the gvrd for years and sold to everybody, even being a retailer for a while. He says *you* fucked *him* over. As far as stepping forward to do the right thing, it sounds like you may have a little stepping forward to do yourself. Perhaps if you own up to the part you played he might be more receptive. |

His M4 was well, well used as well, and the M14 package, given how NEW it was (used in ONE FR game), works out to about the same price. $1005 for a TM M14 + 6 additional mags + large batt, for the M4 pkg he was selling for $1000. Don't try to pull that convenient spin wording with me. |
None of the information regarding shipping is relevant. Both parties have each others promised property, so no promises were broken there, there were only minor inconveniences. Goldman explained himself in this regard. Since the timing of the shipping has no bearing on the current problem, I'd put that aside and address the condition of the items.
I'd still like to hear from J-AIR on the problems he found with the M14. If there is a CP claim to be made, it should be made. If not, then he can't really complain can he? Similarly if there is an internal problem with the M14 that suggests it has been compromised before shipping, that should be discussed as well. The fact that J-AIR has not come forward to offer any information makes his claims appear to be a dismissive smear rather than a legitimate problem he seeks to rectify. If my rep were on the line, I would be very forthcoming with information about it. |

J-Air's concerns should be equally heard and BOTH parties should address one another's concerns in a fair manner. That what a responsible seller/trader does. I'll make no bones about it, Goldman is a Wolf and if he fucked up on this in any way, he's not only accountable to J-Air, he is accountable to his TEAM. Trust me when I say thats a fair worse fate than anything J-Air can suffer from at his end of the continent. J-Air can be assured he will be treated fairly. I don't want to unfairly characterize him because I don't know him, but I will say if he is trying to pull a fast one, this won't be the end of it, not by a long shot. |
So you are saying you never fired it? You got a gun from someone you don't know and never fired it? You pm'd him after saying star mags don't fit very well in the CA body, but yet you never fired it before you took it apart? Cmon...
He says it's absolute bs there was no nozzle, and I believe him. The peq issue again, you got a broken one that he told you was broken, and a new ics one. What's the issue again? The 203 was a sun project, on a tm ris, on a ca gun. Not the most ideal setup, but you knew that going in. He'd used that gun many times with no issues, so if you broke it... Scarecrow, I think the shipping is relevant, as it's part of the trail of untruth and bad faith. If someone was jerking my chain like that I'd be a little bitter over the whole thing as well. Personal resonsibility... The m14 had the charging handle broken off and the whole thing looking like it had been kept underwater. Hey, so it's a CP issue, shit happens. You asked for pics on Friday, he said "no problem but I'm going away for the weekend", yet even though you knew he'd left you do all these posts here and on our boards over the weekend knowing that he'd gone away. He's back now, I'm sure you'll get pics. Dismissive smear my ass. He says he shipped you a gun without problems and you broke it, you say otherwise, etc etc. Perhaps you each have a reason to bitch? I get the feeling you are going to have to handle this one yourself Goldman, between you and him. He's a reasonable guy, perhaps try being reasonable in return. If you try and talk shit to him you're going to hit a brick wall, I'll tell you that up front. As Scarecrow said, if you two can't come to an arangement, perhaps you should each return the other's property (are you already parting it out?). If you broke the gun, own up to it, get it fixed, and ship it back. The game is all about honour and being overly honest, so too should this transaction. |

Okay, bear with me this is going to be a long one.
Bunny: PEQ – I was told the ICS one I received was supposed to be mint, IE: the NOT broken one, yet it was broken on arrival. I have NOT received a non-broken PEQ from J-Air. The M203 – If the mounting was unstable, he should have stated that to me, not saying its in good condition, this type of problem makes an AEG unusable in my opinion, and as such I would list that. The M14 – Again, why did he not contact me about this when it happened? Why did he WAIT until I confronted him about the problems with the M4 to do so? He had ample time after the arrival of the M14, and even during our PM exchange on Friday to do so. By making me wait until it is “convenient” for him to do so, it would make me wonder if he is in fact staging the M14 to look broken, when it was not. I tried being reasonable, In fact unlike him, I didn't insult him in every private message regarding a problem with the M4. I am merely at my wits end, as he simply has decided to wash his hands of this, and effectively tell me to bugger off. Bunny and BigMatty: I am parting the AEG off already so that I can purchase other parts that will give me a functioning AEG to play with. Unlike most people on these boards, I can't afford more than one primary, and as it stands I've been without a working AEG for quite some time now. I have game, and team obligations that require me to have a functioning AEG. As such I'm working the lemons I was given, to try to make lemonade. I posted the sales up before this thread, as I'd hoped J-Air would have been reasonable in dealing with me, instead of stone walling me. As such I am trying to make the quickest possible solution to this problem. At this point I am not willing to accept the M14 in return, as I have no way of trusting that it will be returned in the same condition as it was shipped. Again, I ask if there was a problem with it on arrival, why did J-Air wait to bring it up until AFTER I noticed the numerous problems with the M4? It just doesn't add up. I would like to see J-Air post here with his information, instead of a third party with skewed information. Mike |

Bit slow to reply here, while typing my last a number of posts were made.
Big Matty: The parts are listed, but still on the M4. After discussing this issue with Gump, our local Armalite Gun tech, and scarecrow the gun was put in its case and left there, and I haven't actively been selling the M203 at this time. It is still attached to the M4. Once J-Air told me not to expect any money from him to fix the M4, I looked for ways to do it within my budget and posted the M203. I decided to go public with this because of the treatment and overall tone of the deal. |
Well, I did talk to him. He's not going to do the asc circus, he wants to deal with Goldman. You aren't going to hear from him here.
The bottom line here is that what Goldman says and what Jair says are two different things. When you say Quote:

As a third party who has absolutley nothing to do with this situation I know my input is totally useless in the situation at hand but it was posted in a public thread so giving my two-cents is my right. It really sounds like some guy wanted to unload his FUBAR'd gun and did what SO MANY of the people in the classifieds do, lied about it's condition and hoped no one would call him on it. No matter what other factors were involved on the trade selling a gun like this through ASC WITHOUT disclosing the guns issues is inexcusible. Listing the gun as being in good condition is just plain fruadulant. I know there are at least 3 sides to every issue but the fact that the for sale post apparently made ZERO mention of the gun's issues, the fact that the seller in question refuses to show up and defend himself, and the fact that he has stated plainly his refusal to make the situation right speaks volumes to his culpability in this. I hope it gets resolved to everyones satisfaction. It all could have been avoided if people would be a bit less forgiving of their own gear when it comes time to sell it. Hell I've seen people throw the word 'MINT' around like it was nothing on the classifieds. GOOD LUCK |

First off,this had been the worst transaction in my life.Anybody who knows me ,or has dealt with me over the 4 years I have been in the airsoft community knows this is not what I am about.Having sold/traded about 15-20 guns over this time(some upgraded,some not ) -there has always been a happy transaction.
To say that I would ship a broken gun-is complete and total crap!! .I chrono'd it as I was boxing it up,and it shot around 380.I owned that gun the longest of any guns,and it recieved great amount attention.As well there is nothing misleading in my ad-I was even going to the trouble to set up a test shoot for anybody .(Kinda hard to do with a gun with no nozzle).If a gun had no nozzle it wouldn't shoot.The nozzle brings the bb up into the hop-up chamber,holds it there-then fires. While boxing it up-I noticed that the mount on the G&P lam was broken(they all break here)-I offered my ICS one that I had sitting on my shelf .This one was in good condition.It was never over tightened--If it was broken--I would have offered some kind of compensation-as I have alot of spare gun parts.Not any more LAM units though. The box I shipped it in was the box the Maruzen L96.This was the only one I had that would fit everything.I even ripped all the foam padding out of another gun case,and used it for padding.Taped the living shit out of it,and sent it off because of his constant nagging to have it before the weekend.After I sent him the tracking number-Nothing!!...didn't hear a word from him for a while.When I suspected a scam-he finally replied days later.He still didn't have any tracking number for me-strange? .When my gun arrived in T.O-he stated that he was going to ship it later that day--TOTAL CRAP!...He said that it was at his parents house-ANY HE HAD FORGOT,BECAUSE HE DIDN'T HAVE THE M14 IN HIS POSSESION.At this time he finally gave me tracking number,and stated" I just paid $60 to send this damn thing to you!"---HAD HE SHIPPED IT WHEN HE SAID HE WAS GOING TO-HE WOULD HAVE ALREADY KNOWN THE SHIPPING.Plus,after my asking couldn't he have asked his parents(if they were really aware they were supposed to ship it for him the tracking #?!!). When my gun showed up-->one corner of the box appeared to have been left in some water(the cardboard all fell apart),and the fabric that the gun was wrapped in was hanging out.The cocking lever had torn though the side of the box.When I took it out the lever was extremely wobbly.I found the lever retainer was almost ready to break free.I have since re-threaded the screw,but it still sits in pieces. To say that he never shot the gun at all-only just opened the metal body to check for cracks-BULLSHIT!....Had he been a straight up guy-no bullshit...I would have sent him some spares.I still have alot of parts from when I used to run SPEC-OPS Airsoft.Another reason I would never sent a broken gun.Why would I?,I have a crap load of verII parts.He has since parted the gun out. Before the deal went south- I asked for no b.s...he told me that he had a deal go bad on him,and this would not be the case. .This should have been the writing on the wall.I should have said screw it-go pound sand.But alas,here I am with this headache. Knowing J-AIR and have had multiple dealings with him I could never seem him shipping somebody a broken gun.
Like mentioned before he is a respected Western Canada Airsofter,Gun Smith and used to retail as well. He opened his home to a Bunch of Edmonton airsofters when we headed to BC for a Weekend game. I have utmost respect for J-Air and couldn't see it in his character to do such BS he is accused of. I guess I shouldn't really post this cause Goldmans buds will back him and vice Versa for J-AIR and it just ends up a pissing contest between the 3rd party's but I couldn't stand to read this with nobody speaking for J-AIR other then Bunny. |

Good to finally see a reply from YOU, not a third party. We have discussed this to death, but I feel I still need to hammer home some points. I still see no pictures of the damage to the M14, nor an explanation for why you did not contact me when the M14 arrived in such a state. Most anyone else here would contact the seller immediately if there was a molested package on their doorstep, as CP claims need to be made promptly, yet you did not inform me of any such problems until I noticed the gaping problems with the M4. Yes, it is reasonable that I did not get a chance to fire the M4, as I didn't attend a game, where am I to fire it in my parents house? Perhaps take a stroll in their backyard, just off a major street and let some rounds loose? I'm sure that would have ended fantastically. The LAM unit is broken, and it is not broken in away that would scream shipping error to me. It was broken, as you say it “in the way they all break”, in that the plastic clamp was cracked in half. You have offered no explanation to how this might have occurred, and now refuse to believe there was damage at all. In regards to shipping, I already made my case. I asked my parents, who were in possession of the M14 to ship it, I was assured it would be. Later when I asked about a tracking number from them so I could PM it to you, they stated they had not yet shipped it. Given I was going to their place late Thursday evening, I elected to ship it myself on the Friday. Also if I am not mistaken, I took me roughly a day and a half to reply. Like you, I too have a life, school etc., which precluded you from replying to other Pms I sent you in a timely manner, how would you expect me to? Also, you keep making a deal about how if I had shipped the M14 i would have known how much it costs. I don't understand what your trying to argue here. I've already admitted on several occasions the M14 was shipped late. What are you trying to get at? Also, as previously stated, I cannot have AEGs, GBBs, Paintball guns, or Real Steel at my current residence, its a term of my renting here. As I already said in this post, it would preclude me from testing a new AEG arrival for shooting until I can either get it to a game, or someone's home who has a decent area to try it. Upon receiving the AEG, I dry-fired it, simply to see if it cycled. For the very reasons you say you wouldn't screw me, I trusted you. However once I was able to open the mechbox and take a look, I found problems. Let me ask you this, if I was out to screw you over this deal, why would I be making such a fuss over the nozzle? If this were simply an attempt to bleed you of money fore replacement parts, why would I not have simply said something to the effect of “the MB is making a grinding noise”. I wouldn't choose a $10 part, as there is no point in going to this much trouble to get it from you. You mention years of transactions without problems. I too have been making transactions since 2001, and the only trouble I've had are from other people (IE: their AEGs not showing up at all, showing up BROKEN, such as this case, etc.). If anyone is bullshitting here, I would say it is you. As the problem with the M14, only was reported AFTER I reported the problems with the M4 to you. You claim this was a painful deal for you, however I hardly see how that is. You were able to get a fully functioning, barely used M14, and mags, which at the moment is a relatively hard AEG to get, and in return, I get a hodgepodge of parts that was put into an AEG, that I can't even use. This “headache” as you call it, is easily resolved by you simply owning up to the fact that you sent a broken AEG out, and do the right thing, by offering to either send replacement parts, or agree to cover part of the repair cost. This is ALL I've ever asked of you in this transaction, yet your absolutely against it. It makes me wonder why you were so eager to take a deal that you now say was so bad for you, yet now I suppose that reason is clear. At the time of writing this, it is roughly 6pm EST, on the 4th of February. At this point it would appear that J-Air does not intend to make the situation right. At this point I'm just going to make good on a previous comment, to make lemonade out of the lemon I was given. I will be making for sale posts shortly listing the parts I have for sale, in an attempt to salvage something at least from this all.
We have not yet seen any pictures of the damaged M14, nor have I had any further communication from J-Air, and to me, this means that your saying that I was right, there is NO damage to the M14, and your just too damned much of a coward to admit it. You hide behind the statement that you don't want to take part in the ASC circus. Yet the only public thread on BCAC regarding this was locked, by you. You also make claims on BCAC about ASC being communist or some totalitarian regime, yet you, yourself, have locked and made locked posts regarding this issue on BCAC. While this hypocrisy may seem off topic, I think it speaks volumes about what kind of person you are. You refuse to own up to the truth, and only defend yourself in a medium that you have total control over. Needless to say, you can say goodbye to any further business you may have had with me, and as for the other members of BCAC, while I do not wish to throw the baby out with the bath water, as scarecrow so susinctly put it, there are some among you who I will not wish to deal with, namely Bunny, for reasons that I think are fairly obvious. I would also ask that certain Admins/Mods who have a more personal connection with this event, and the parties involved recuse themselves from further action in this thread. Namely “Archiving” this thread without telling anyone, and forcing me to track down another mod to have the thread re-instated. This type of action is childish, and in my eyes, and admission of guilt on behalf of J-Air. Since it would appear that one of this friends abused their power, trying to make this thread disappear once already. While I don't have any direct proof of this... Well I am able to put 1 and 1 together. |
