Well, I'm thinking about this. Like I said, yes, I asked a CSN union worker to represent me on monday. I don't know all my right as a worker and this is why I asked him to be present. All the union workers are with and I'm talking with them as soon as something new happens. And since the beginning. Yes I have in mind to treathen them to sue them, but in fact, I don't have the knowledge and, most important, the money. So I'm asking you, yes now that I "cooperated" with them I became very tired of this game. What can I do? Is there some kind of lawers or ogranism that can help me for free? I'm in a very bad financial situation right now, I'm actualy owning more money than I'm wining in a month, so I really can't pay a lawer. I have the weekend to think about this, I live in Laval/Montreal. Any ideas where to seek juridic conselance for free? Thanks again for your participation!
And yes as soon as I clear my debts I'm quiting this job. Actualy it's my financial situation that hold me there, nothing else. And thanks for the kinds words. Yes I'm playing it cool. But I can't say that I'm not very tired and that it takes some physical tone on me. No one speaked with me before. Actualy they played very cheap. I was, as I said, in "un arrêt de travail" a medical week off. They told me to see my doctor to have a paper to go back to work. I did, and as soon as I finished saying those words, they told me: ok. We refused your coming back. You must see a medical psy to come back because of some disturbing videos. Tomorrow. It all went very fast, 2 days in total begining from the "we refused" to the "you are under arrested" to now. I'm trying to sort everything out and I appreciated your help, even if most of you are finding me too calm and soft Last edited by Sim123456; January 14th, 2011 at 19:42.. |

Seriously Sim, you need to pull your head out of your ass and realize that your Charter rights were violated 8 ways from Sunday. Your reputation not only at your workplace but in your profession is now completely tarnished. Slander can completely ruin the rest of your career. I don't completely know the Quebec civil code or labour laws, but in Ontario you could sue the hospital easily for a pretty good sum and win. I would bet that if you spent a few hours(maybe a day) you could find a lawyer who would do the work. I just googled "pro bono lawyers in Montreal" and a few popped out. As said before this doesn't affect JUST YOU. This is a very dangerous precedent to be set if you don't fight back. |

We live in a world where an 80 year old cancer survivor has to show her prosthetic boobs in order to board a flight..... and people are ok with this.
http://www.vancouversun.com/health/w...074/story.html At the end of the day, this serves as a reminder, that as individuals we need to manage perception, whether we like it or not. Charter rights or not.. this is a road I don't think anyone really wants to go down.

Not exactly applicable to this case as the OP has said the police did in fact have a warrant, but this is a clear indication of how the police WILL try to get you to slip up and grant entry for their "fishing" expeditions no matter how flimsy their so-called evidence is. It's worth reading.
Posted from another forum: "...At 3:30, I pick up my mail and note that I have a package waiting at security. This is standard operating procedures for my condo. Security signs for packages. I actually had 3 packages. One package consisted of two CZ858s (one restricted, one non-restricted) and two individual crates of 7.62x39. Although the CZs were discretely packaged, the ammo was not. Ultimately, the last line of this thread is the one everyone should pay heed to. You have rights, use them or lose them. 'Fly

There are pictures of me (and video probably) with guns, I don't have a PAL, so I must be an illegal firearm owner and worth being warranted and searched, yes? You're a PAL holder, who also collects Airsoft guns. Someone sees a picture of you with a, I don't know, big ass gun, say a Barret, an Airsoft Barret, but who could tell? Soccer mom sees this picture of you with the pretend gun, calls the cops because her kid learns karate from you, cops check picture and registry and see you don't have a Barret registered and toss your home and place of business... sound fair? Sounds vaguely familiar too... (I don't know if that was true, it was just an example) It seems to me that [seemingly] logical steps were skipped. Like using words first and freaking out later.

The first part of the problem is the employer. Let's just focus on that for now because everything after that came from it. Let's look at this using the KISS method : Is it illegal to talk in a room with other people about getting a PAL? NO. Is it illegal to be on sick leave and own guns? NO. On the other hand what is illegal in this story? This is where legal councel is needed. Like it's been said before, getting legal councel is the best alternative and being syndicated is one of it's privileges because it's ''FREE'' but only appliable against your workplace. That part of your paycheck that gets taken away on every pay, this is one of it's benefits so use it. You have representatives so you dont need to learn all those technical terms. USE THEM. People at my job have been in court versus my employer a couple of times in the past because of an ass wipe boss with the caracter to match. He lost everytime Just remember that you can bypass your local representative if you feel that he is being condescendent. Some are corrupt so it's a good idea to go higher if he pushes in the wrong direction. You are paying to the central, not to him, so your rights have to be enforced. What you dont fight today will haunt you tomorrow. |

Hmm I wonder if there are any hunters on the hospital staff, I can see it now:
Employee: Boss, while wasting the taxe payers money on the Internet, I saw a video of Robert on Youtube, he killed bamby with a gun and then (sobing) he used a big knife to cut his belly open and then he cut the head off and put it on his truck. He was smiling too! Boss: Good god women, the guy's a maniac, we cant have a blood crazy killer roaming the hospital, what will happen if someone bleeds in front of him, he will cut their head off! Employee: Save us Boss, save us! Boss: Dont worry, Superboss is here (removes his glasses), let me call the chief of police. Chief of police: Hey John, are you calling me about your wife beating you again? What? One of your employees is killing people and hes not a doctor! Don't worry, the SWAT team is almost finished playing COD, I will send them right after their coffee break! You know the rest of the story Sorry Sim, I hope the situation resolves itself without you doing anything about it, after all your boss and colleagues seem like reasonable people. |

I took a while to get involved in this because I have a similar case on the table, minus the airsoft guns.
What happened here is you got pissed on, without even the courtesy of having it called rain. Your union rep will be able to help you. I'm glad you're onboard with this already. As for legal advice, call up the Barreau de Montréal (http://www.barreaudemontreal.qc.ca/). Ask for a referal for a lawyer that deals in "relations de travail" and that would be willing to work per commission. Usual rates from what I've gathered are 5% to 10%. Before you sit down with a lawyer, put on paper any and all damages you have been dealt by this. Lost wages, medical costs and whatever. Also write down the timeline of all that happened. Note down every little detail, even those you might have omitted here. The first consult with a lawyer on the island of Montreal is 30$ for 30 minutes. This is why you want to be organised. Ask about your options and make a plan. Unless there is a specific reason to stay, I'd change jobs. One of the things you might be able to negociate in a severance package is a referal to another hospital. Set specific demands as far as wages, job type, hours are concerned. Finally, take stock of what happened and remember to keep certain hobbies on the down low. Good luck. |

Thank you. Great advices. I already have the number of "Le barreau du Québec". I decided to pull back a little this weekend and try to change my mind a little bit. Also I have a reunion with my union rep monday just before we go to the other "reunion" with the hospital admnisitrator. I already have in mind what I lost up to date (Integrity, reputation, physical and mental healt, a 2000$ good, my right to have a PAL etc.). Sure I can probably get my M14 back, but until it is in front of my eyes I decided to count it as a lost. I can't trust completly the system about "having it the next week". But I'll decide everything with the monday reunion. I already have the "I'm actualy looking for a lawer to sue to get compensation" card and argument since it's true anyway. I'll keep you guys informed!

odd question somewhat on topic for the community, if any legal action goes through will it neccessarily count as precedince for the rest of the country, i seem to recall that quebec was operating under civil law while the rest of the country operated under what is essentially british commonlaw
just curious and to Sim, good luck getting your gun back mate, it really sucks how you got treated, you are taking it far more calmy than i would. Im just lucky people at my work know im an airsoft nut, and enough of them are intrigued about starting up, or have played in the past that i dont have to worry about talkin about it on break at work, or any of them calling the cops on me.
